رسالة مفتوحة من أسرة الصحفي حميد المهدوي إلى رئيس النيابة العامة

الموضوع : طلب وفاء بإلتزام قانوني وأخلاقي وقضائي

سبق لكم السيد الوكيل العام المحترم أن صرحتم يوم 25 يونيو 2018 خلال إحدى جلسات محاكمة الصحفي حميد المهدوي "إطمئن سي المهدوي سوف نحضر البوعزاتي " وقد مضى مايزيد عن 13 شهرا. ولم يُحرك ساكنا في الموضوع ولم نسمع أنكم أحضرتم البوعزاتي أو حتى إستدعيتموه أو قدمتم مذكرة بحث في حقه بحسب مايخوله لكم القانون من مساطر .
والغريب أنه مؤخرا تبادلت السلطات المغربية معلومات مع السلطات الهولادنية حول متهمين في قضية مقهى "لكريم" في مراكش ومؤخرا أيضا تسلمت السلطات المغربية من نظيرتها الهولاندية متورط في جريمة مالية .
كما سبقا للمغرب أن طالب بتسليم سعيد شعو .
ألا يمس هذا بمبدأ النزاهة ومبدأ ربط المسؤولية بالمحاسبة
والأهم ألا يسائل هذا تصريحات المسؤولين القضائين حول الأمن القضائي للمغاربة
مع العلم أن السيد المهدوي صرح عشرات المرات أمامكم السيد الوكيل العام أن المتصل صاحب الدبابة مجرد نصاب لا علاقة له بالبوعزاتي ولا بحراك الريف.
والقضاة قالو أنه ينتمي لحركة انفصالية بناءا على معلومة مجردة من أي دليل قدمها لهم رجال البوليس ورغم ذلك لم يستطيعوا إحضاره.
ورغم تشبتنا بأن الملف مفبرك ورغم أن السلطات لحد الساعة لم تحجز أي دبابة أو أسلحة قادمة من هولاندا ، ولاحجزة اي دليل مادي بين صاحب الدبابات والمتابعين على خلفية أحداث الريف، ورغم أن أخ البوعزاتي قال إنه لا يفقه في السياسة ولاعلاقة له بها"ولبغا يديرها ميعرفش ليها"، ورغم أن البوعزاتي الحقيقي خرج بفيديو على اليوتيب وصرح أنه لم يسبق له أن إتصل بالمهدوي، ورغم ورغم ورغم ...مازال الصحفي حميد المهدوي صاحب الجريمة الفرعية يقضي زهرة شبابه خلف القضبان ببنما صاحب الجريمة الأصلية حرا طليق.
والغريب أن المحكمة رفضت طلبنا بإجراء خبرة على صوت صاحب الدبابات لمقارنته بصوت إبراهيم البوعزاتي
كما رفضت الإستماع إلى شهادة أخ البوعزاتي وهو موجود في طنجة، كما رفضت مجرد السماع لتسجيلات الهاتفية داخل المحكمة واكتفت بما دونه رجال البوليس.
أتفهم أن تحقد الدول على المهدوي بسبب أرائه الصحفية لكن ما لا أجد له جواب هو أين الوفاء بالالتزامات وأين هو الحرص على الأمن القضائي للمغاربة ؟؟؟
وختاما لا أحتاج تذكيركم ان المؤمن" إذ عاهد وفى بوعده "
خاصة أن الاسلام هو دين الدولة وفق الفصل 3 من الدستور.

An Open letter from the family of journalist Hamid Mahdaoui to the Chief Prosecutor

Subject: Request for fulfillment of a legal, moral and judicial obligation.

Honorable Attorney General,

You stated on June 25, 2018, during one of the trial sessions of journalist Hamid Mahdioui, "Rest assured Mr Mahdaoui, Bouazizi will be brought to the court. It has been more than thirteen months and nothing has been done in the matter. We have not heard that you brought Bouazati or even summoned him or submitted a research note, according to the law.

Strangely enough, Moroccan authorities recently exchanged information with the Dutch authorities on suspects in the case of a cafe "LKarim" in Marrakech. Also, the Moroccan authorities received a suspect involved in a financial crime from their Dutch counterpart.

Morocco has also demanded the extradition of Said Chaou.

Does not This prejudice the principle of integrity and the principle of linking responsibility to accountability?

Most importantly, this does not question the statements of judicial officials about the judicial security of Moroccans,

Knowing that Mr. Mahdoui, Mr. Attorney General, had announced dozens of times before you that the phone caller, owner of the tank, just a a con man who has nothing to do with Bouazati and Hirak of Rif (Rif civil manifestations).

The judges said he belonged to a separatist movement on the basis of information devoid of any evidence provided to them by the police, though they could not bring him.

Although we clinch to the firm confirmation that the file is fabricated and that the authorities have neighter seized any tanks or weapons coming from the Netherlands, nor it had its hand on any material proof linking the owner of the tanks and activist of Hirak of Rif arrested. Although the brother Bouazati said that he does not have any links to politics, and that "if Bouazizi wants to take part in political actions he would not know how". Although the real Bouazati, himself, came out with a video on YouTube announcing that he had never contacted Mahdaoui, the journalist Hamid Mahdaoui,who is partly linked in such a crime is behind bars, while the official suspect is free.

The court rejected our request for an experiment on the voice of "the tank owner" to compare it to the voice of Ibrahim Bouazati,

It also refused to listen to the testimony of Bouazati's brother, who is in Tangier. The court also refused to hear the telephone recordings inside the court and confided only to the policemen.

I understand that the state are resenting Mehdaoui because of his press opinions, but what I have no answer for is

Where is the fulfillment of obligations and where is the concern for the judicial security of Moroccans ???

In conclusion, I do not need to remind you of the words of the Messenger of God which says that a believer is bound to his Word,

especially that Islam is the religion of the state according to Chapter 3 of the Constitution.
